General Terms

§ 1 - You are purchasing/obtaining a digital file, with full personal rights to use it.

(1.1) As the designer and reference artist, AstralRam does retain the right to use their artwork (the design reference(s)) for their portfolio, commission samples, and social media accounts.(1.2) Sharing AstralRam's art of your character outside of Toyhou.se requires a link back to https://astralram.art

§ 2 - Once purchased and transferred to you, the character becomes yours, and you retain full rights to personal use of the design in your art, stories, and any other non-commercial media.

(2.1) You can do anything non-commercial with your character, as long as it abides by these terms, Toyhou.se's terms, and the terms of any other sites, social media, or servers where you may post about the character.

(2.1a) If you are caught breaking terms of Toyhou.se or other online services through use of your character, AstralRam will not be held liable for any account or other losses you may incur.(2.1b) If you are caught using a design made by AstralRam to spread hate speech or other forms of bigotry, you will be subject to blacklisting and blocking. (The character will remain yours, but AstralRam retains the right to refrain from doing further business with you.)

(2.2) You may not use the obtained digital file/art, or any form of the character design, for generative AI purposes (this includes, but is not limited to: training an AI and generating images from an AI).(2.3) You are free to private or auth-lock the character without giving AstralRam notice. Getting a key to retain viewership of the design is greatly appreciated, but entirely optional. (If you wish to give a key, please send it via DM here on Toyhou.se!)

§ 3 - Co-owns are allowed on all designs made by AstralRam.

(3.1) If you wish to co-own a design that is part of a closed species, please check with the species about whether they allow co-owns. A species's terms regarding co-owns automatically supersede AstralRam's.(3.2) It is always up to you, and whomever you co-own with, to keep track of your ownership; AstralRam holds no responsibility over your co-own.

§ 4 - When reselling, trading, and/or gifting designs, please be reasonable and use common sense.

(4.1) There is no cooldown on reselling, trading, and gifting designs after obtaining them.(4.2) When reselling, you can only sell for the USD value of the design (or lower).

(4.2a) The design's value resets to 0 USD if your character is obtained via trade, free raffle, or gifting (even if the value has previously been higher).

(4.3) When trading, please only trade for reasonably equal worth.

(4.3a) Trading designs you obtained for free/via gifting is not considered reasonable, unless you have added art to it.

(4.4) Both commissioned and personal art may add value to your character.

(4.4a) For personal art to add value, it must be a minimum of a clean, coloured sketch (monochrome/greyscale is also accepted; just no low-effort doodles).(4.4b) Please do not abuse this clause to inflate your character's value/worth - be sensible when pricing.(4.4c) Art obtained via trades, gifts, free raffles, and/or events such as ArtFight and "draw the OC above" do not add value to your character.

(4.5) Reselling/trading/gifting to someone outside of Toyhou.se is allowed, but not encouraged.

§ 5 - In cases where you leave Toyhou.se, you are free to take your character with you.

(5.1) Optionally, you may also send your character back to AstralRam.(5.2) If you wish to delete your character's profile, please let AstralRam know through a DM.

Redesign & Species Terms

§ 6 - You may redesign your character, as long as they still resemble the original design in some capacity, and as long as you keep the original design in your character's gallery (putting it in a separate tab under the same profile is allowed).

(6.1) Changing clothes, species, gender, and palettes is always allowed, along with creating alternative forms/alternate universe versions of your character.(6.2) You may edit AstralRam's reference art for subtle/minor changes - such as hue shifts and changing feet to paws/hooves - as long as the art is still credited to AstralRam.

(6.2a) You may not make major edits of AstralRam's art for redesigning. If you wish to make major changes in your redesign, please redraw your character reference.

§ 7 - You are freely allowed to add your character to a species, as long as you follow the redesign terms in §6, as well as the terms of the given species.

§ 8 - If the design you have obtained is already part of a species, you are allowed to redesign it according to the terms in §6 and the rules of the species.

§ 9 - If the design you have obtained is already part of a species, you are freely allowed to void/remove them from the species, as long as you follow the terms in §6 and the species' process for voiding.

(9.1) If voiding protocol for the species requires removing certain traits, you are fully permitted to do this.

§ 10 - There is no need to ask AstralRam for permission on adding, redesigning, or voiding your species character. If permission is needed, please show the species this ToS.

(10.1) You are not obligated to inform AstralRam of any adding, redesigning, or species voiding, but you are welcome to do so if you wish.

Commercial Use

§ 11 - A commercial use license can be purchased at any time after obtaining your character.

(11.1) Please request a commercial use license through a DM to AstralRam on Toyhou.se (with the subject "Commercial Use").(11.2) Prices for a commercial use license are quoted on a case-by-case basis, at the discretion of the designer, through dialogue with the character owner.(11.3) Commercial use licenses are not transferable between owners. If your character gets a new owner, the license will automatically be voided. If a new owner wants to use the design for commercial purposes, they would need to purchase a commercial use license of their own.(11.4) Commercial use includes using the design for profit in stories, on merchandise, or as a mascot for a monetised Twitch/YouTube channel. NOTE: Commercial use is not the same as purchasing copyright of the design/purchasing a buyout!

Payment Policy

§ 12 - All design sales are final. No refunds will be allowed.

(12.1) You will receive your design through a Toyhou.se character profile transfer after payment confirmation has been made.(12.2) AstralRam retains the right to decline sale on any design, without need for further explanation.

§ 13 - All sales are in USD and paid either via PayPal or Ko-fi.

(13.1) If you reside in a country that uses MobilePay/Vipps, you may opt to use this instead of the above options.

(13.1a) Sales made through MobilePay/Vipps are in DKK, according to the conversion rate of USD to DKK set by Lån & Spar Bank A/S.

§ 14 - Payment plans and holds may vary per design, at the discretion of the designer.

(14.1) Payment plans are available from 50 USD and above.

(14.1a) A non-refundable deposit of 10-20% of the full price must be made upon confirmation of the payment plan.

(14.2) Holds are available at any price.

(14.2a) A reasonable maximum hold period for a design will be set through discussion between buyer and seller.

§ 15 AstralRam retains the right to decline sales, payment plans, and holds on any design, without need for further explanation.

Additional Terms

§ 16 - There is a permanent discount on commissions involving characters designed by AstralRam.

(16.1) If you commission AstralRam to draw any design they have made, you are subject to a minimum discount of 5 USD (and a maximum of 50 USD), depending on the commission total, at the discretion of the artist.
